Indictments for offenses including aggravated sexual assault, escape and possession of controlled substances were among those handed up April 24 by a Johnson County grand jury in Judge John E. Neill’s 18th District Court in Cleburne.
Alvin Floyd Vaughn, 55, of Cleburne was indicted April 24 for an enhanced charge of escaping while arrested or confined. He was indicted twice in April and has been to the penitentiary four times, District Attorney Dale Hanna said.
Vaughn was indicted in the 18th District Court on April 3 for an enhanced charge of leaving the scene of an accident involving injury or death. Two weeks later, on April 17, he escaped from a work detail at the Johnson County Corrections Center, according to sheriff’s reports.
Vaughn was apprehended April 18 in Edgecliff in a joint effort by Johnson County Sheriff’s Office deputies, Texas Rangers, U.S. marshals, the Johnson County Stop the Offender Program Special Crimes Unit and police officers from Fort Worth and Cleburne.
Before escaping, Vaughn had been involved in a car accident in Burleson. He’s also been to the penitentiary several times, Hanna said.
In 1981, Vaughn was indicted for unauthorized use of a vehicle in Tarrant County. He faced the same charge again in 1987. In 1985, Vaughn was indicted in Johnson County for theft by check. In 1992, he received a life sentence in Hood County for unauthorized use of a vehicle.
He served ten years of his life sentence and was released on parole in 2002, Hanna said.
Vaughn is on parole until 2091.
“The unique thing about this deal is he’s on parole for a long time,” Hanna said. “But then he hadn’t been in trouble for a long time until he had this wreck in Burleson.”
Vaughn, who was intoxicated at the time of the February accident, fled the scene. Passengers in the other vehicle had minor injuries.
“If he had stayed at the scene of the accident, he would have been guilty of a misdemeanor charge of DWI,” Hanna said. “But he chose to leave, and that made it a felony.”
Two weeks after being indicted for the accident, Vaughn fled again.
His motives for escaping from jail could have been spurred by fear, Hanna said.
“I guess he was under the impression that he’d go to the pen for a long time, so he decided to run,” said Hanna, who has not decided what recommendation to make for Vaughn’s sentence.
“But he’s definitely going to do some more time in the pen,” Hanna said. “We cannot tolerate escape.”
David Nicholas Appleton, 41, of Cleburne was also indicted in April for aggravated sexual assault of a child.
Appleton is accused of assaulting his stepdaughter, now 18, and fathering one of her children.
Appleton allegedly had a sexual relationship with his stepdaughter, Shaye Lejeune Appleton, from November 2002 to September 2006. A DNA test verified he is the father of her oldest child.
Appleton is being held in the Johnson County Corrections Center on a $600,000 bond.
His trial has been set for June 2 in Judge Wayne Bridewell’s 249th District Court.
“It’s going to be a major trial,” said Hanna, who refused to comment further because it might interfere with jury selection, he said.
Appleton was also indicted in 2007 for assault of a child and indecency with a child.
Other indictments include possession of controlled substances.
Manuel Lang III, 25, of Marlin and Detrick Demond Mason, 26, of Fort Worth were indicted for possession of a controlled substance between four and 200 grams with intent to deliver.
Lang and Mason were arrested Jan. 11 in Alvarado after a traffic stop for speeding on I-35, Hanna said.
Then the STOP task force discovered Lang and Mason had 61 grams of cocaine in their possession, Hanna said.
Drugs continue to be a problem in Johnson County, Hanna said.
“Methamphetamine is certainly a major problem, but the STOP task force is doing a good job getting meth and other drugs off of the streets,” Hanna said.
Jeffrey Glenn McFatridge, 26, of Jacksboro and Jennifer Nicole McKnight, 24, of Mineral Wells were indicted for possession between four and 200 grams with intent to deliver. McFatridge and McKnight had 51 grams of meth and $5,270 in cash in their possession when they were arrested April 16.
Officials confiscated the drugs and filed a seizure on the money because they allege the money is the result of drug dealing, Hanna said.
