A 33-year-old Alvarado man was taken into custody Sunday and transported to a trauma unit in Tarrant County as a result of a family dispute that ended when the suspect, Joshua Adam Lewis, was shot once by Johnson County Sheriff’s Office deputy Jared Fuller.
Fuller and deputies Justin Smith, Lanny Boone and Tony Masden responded to a 911 call in the 4000 block of County Road 610 at about 5:30 p.m. Sunday.
The suspect had allegedly assaulted two of his three children after arguing with his wife.
The wife and children had fled the scene to avoid further violence and before the arrival of the deputies, according to a press release from JCSO.
“The wife said they’d been at a friend’s house, and [the suspect] was drinking and got out of control,” said Sheriff Bob Alford on Monday. “She told him it was time to go home. He was bad-mouthing the women’s deceased father, and she told him to knock that off.”
The girl, 8, was struck first in the ensuing scuffle, Alford said. The boy, 10, was struck second.
Alford said both children spent the night at Cook Children’s Hospital.
“At first, we thought the girl had a broken arm, but that was not the case. The wife was not hit,” he said.
The suspect was armed with a club, Alford said, and refused to surrender to the deputies.
“They yelled numerous times for him to drop his weapon,” Alford said.
“There was evidence the suspect was armed,” according to the press release. “The suspect then fled to the inside of his home and momentarily ran out the rear door toward the deputy who was securing the rear of the residence.
“The deputy continued to issue verbal commands to the suspect to stop and put down his weapon. The suspect continued rushing toward the deputy with the weapon in his hand when the deputy fired, striking the suspect.”
One bullet penetrated the suspect’s lung, Alford said.
Alford, who also responded to the disturbance, said he’s comfortable with the actions of the deputies.
“We have video and two witnesses,” he said.
As of Monday afternoon, Lewis had not been charged.
Charges of domestic violence and child abuse will be investigated by JCSO, Alford said.
Texas Rangers will investigate the shooting as is standard procedure, and an internal review will be conducted, also standard in use of force incidents.
